The Flint Cable Television QVC Gift Card Giveaway (hereafter referred to as “Flint Giveaway”) is sponsored by Flint Cable Television, 4 East William Wainwright Street, Suite 2, P. O. Box 669, Reynolds, GA 31076. The Flint Giveaway is governed by these Official Rules. By participating in The Flint Giveaway, each entrant agrees to these Official Rules, including eligibility requirements. The Flint Giveaway is subject to all federal, state, and municipal laws and is void where prohibited by law.
Eligibility
The Sweepstakes is open to all Flint Cable Television customers residing in the state of Georgia. MUST BE EIGHTEEN (18) YEARS OF AGE AS OF JUNE 14, 2010 TO ENTER. Officers, Directors, Board Members, Employees, Agents, sub-contractors of Flint Cable Television or one of its subsidiaries and their immediate family members (defined as spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren) are not eligible to win.
Entry
The Sweepstakes begins at 8:30 am on June 14, 2010 and ends at 5:30 p.m. on July 31, 2010. Manual Entries: Entrants must provide their name, address, phone number, and email address on a three by five (3 X 5) index card and mail it to: Flint Giveaway, P. O. Box 669, Reynolds, GA 31076. Only cards received by 5:30 pm, July 31, 2010 will be eligible. Only one mailed entry per customer during giveaway period. Flint Cable Television is not responsible for cards lost or damaged in the mail. Entries that are late, illegible or incomplete for any reason will not be eligible.
Prize
Flint Cable Television will award a total of one (1) prize. One (1) individual will be selected in a random drawing from among all eligible entries received during The Flint Giveaway period to win one (1) $50 QVC Gift Card prize, valued at $50. No transfers, substitutions in prize(s) or cash award substitution will be allowed. The odds of winning depend on the number of qualified entries received. ALL EXPENSES, TAXES, AND COSTS ASSOCIATED WITH ACCEPTANCE OF THE PRIZE, AND THE REPORTING CONSEQUENCE THEREOF, ARE THE SOLE OBLIGATION OF THE WINNER. PRIZE IS AWARDED WITHOUT WARRANTY OF ANY KIND BY SPONSOR, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OF ANY PRIZE INCLUDING, WITHOUT LIMITATION, QUALITY, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.
To claim the prize, the winner must sign and return a release and affidavit of eligibility and publicity to Flint Cable Television at P.O. Box 669, Reynolds, Georgia 31076 or prize will be forfeited. The prize is neither transferable nor exchangeable and will be awarded only if entrant complies with these Official Rules. No other consideration will be paid. Name of winner will be provided by phone call request once winner has been notified, eligibility confirmed and all required signatures obtained.
Drawing
The Flint Giveaway drawing will be held on or around July 31, 2010. Only entries received before the end of the Flint Giveaway period will be eligible. The odds of winning depend on the number of eligible entries received. Winner will be notified by e-mail. If a phone number is provided, Flint Cable TV will make every effort to also contact winner by phone. Winner must respond by contacting the Flint Cable Television marketing department by e-mailing
llong@pstel.com or calling 847-6415 by the close of business August 9, 2010 (5 business days later) or an alternate winner will be selected from amoung the remaining eligible entries. Flint Cable will make every effort over the 5 business days to locate the winner through reasonable, good-faith efforts by Flint Cable TV. Prize must be picked up at the Flint Cable TV business office no later than the close of business five (5) days immediately following contact or prize will be voided. Winner will have the option to have their $50 gift card mailed, however, Flint Cable Television will not be responsible for gift card after mailed from the Flint Cable TV offices. If winner does not receive their gift card in the mail for any reason, it is not the responsibility of Flint Cable to replace the gift card. Winner will have gift card mailed at their own risk! Alternate winners: Alternate winners will have the same 5 business day time frames allowed for contact and pick up their prize. Entrants agree to be bound by these Official Rules.
Publicity
By submitting an entry form, each entrant grants Flint Cable Television, and those acting under its authority, permission to use his/her name, likeness, and comments for advertising or publicity purposes without payment of additional compensation, unless prohibited by law.
Data Collection/Privacy
Flint Cable Television will be collecting personal data about participants when they enter The Flint Giveaway. Personal data includes: name, address, email address, and phone number(s). The information collected is never sold, given or disclosed to third parties.
Indemnification and Limitation of Liability
It is not the responsibility of Flint Cable Television whether winner has access or not to the QVC channel. Once prize is awarded, winner releases Flint Cable Television from any obligations. It will be completely up to winner to redeem gift card through QVC. All QVC rules apply for gift card redemptions and is not the responsibility of Flint Cable Television. By entering this Flint Giveaway, each entrant agrees to indemnify, release, and hold harmless Flint Cable Television, its subsidiaries and affiliates, distributors, vendors, advertising and promotional agencies, suppliers and all their respective officers, directors, employees, representatives and agents from any liability, damages, losses or injury resulting in whole or in part, directly or indirectly, from that entrant’s participation in The Flint Giveaway and the acceptance of the prize
OR WHILE ENTRANT IS TRAVELING TO AND/OR FROM A LOCATION TO OBTAIN OR USE THE PRIZE. ALL FLINT GIVEAWAY WINNERS WILL BE REQUIRED TO SIGN A LIABILITY RELEASE PRIOR TO ACCEPTANCE OF ANY PRIZE. FURTHER, NO RESPONSIBILITIES ARE ACCEPTED BY FLINT CABLE TELEVISION FOR ANY ADDITIONAL EXPENSES, OMISSIONS, DELAYS, OR ACTS OF ANY GOVERNMENT OR AUTHORITY OR FOR FAILURE OF THE EVENT TO TAKE PLACE FOR ANY REASON. Flint Cable Television is not responsible for any on-line entries which are not received due to interruptions of service, whether caused by Flint Cable TV, any of its subsidiaries or from services or computer related issues on behalf of entrant. Entrant agrees that any and all claims, judgments and awards shall be limited to actual out-of-pocket costs (but in no way including attorneys’ fees, disbursements or court costs) and under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and consequential damages, and any other damages, other than for actual out-of-pocket costs.
Governing Law
All issues and questions concerning the construction, validity, interpreting and enforceability of these Official Rules, or the rights and obligations of entrants and Flint Cable Television in connection with The Flint Giveaway, shall be governed by, and construed in accordance with the laws of the State of Georgia.
The Flint Giveaway is governed by these Official Rules. By participating in The Flint Giveaway, each entrant agrees to these Official Rules, including eligibility requirements.
